DFO ONLINE MULTIPLAYER — TERMS OF SERVICE

Last Updated:

These Terms of Service ("Terms") govern access to and use of the DFO Online multiplayer project, website, servers, software, community services, and related features ("DFO Online" or the "Service").

By accessing or using the Service, you agree to these Terms.

1. UNOFFICIAL FAN PROJECT

DFO Online is an independent, unofficial community project.

DFO Online is not affiliated with, sponsored by, endorsed by, or approved by Bethesda Softworks, ZeniMax Media, Microsoft, or their affiliates.

The Elder Scrolls, Daggerfall, Morrowind, and related names, characters, settings, artwork, trademarks, and other intellectual property are the property of their respective rights holders.

Nothing in these Terms claims ownership over Bethesda or ZeniMax intellectual property.

2. ORIGINAL GAMES ARE NOT PROVIDED

DFO Online does not provide, sell, or distribute copies of The Elder Scrolls II: Daggerfall or The Elder Scrolls III: Morrowind.

Where particular functionality requires data from one of these games, users must obtain and maintain their own legitimate copy through an authorized source.

Users are responsible for complying with the license terms applicable to their copies of those games.

The Service is not intended to bypass purchasing, owning, licensing, or legitimately obtaining any required game or content.

3. LOCALLY SUPPLIED GAME DATA

Certain DFO Online functionality may use data supplied from games legitimately installed or provided by the user.

Where supported, processing, interpretation, conversion, or rendering of required game data occurs from the user's own game files.

DFO Online does not grant users any ownership interest or additional license in third-party game data.

Ownership of or rights in the underlying game content remain with the applicable rights holder.

4. MULTIPLAYER SERVICE

DFO Online provides independently developed multiplayer and community functionality.

Access to the multiplayer server is provided separately from ownership of Daggerfall or Morrowind.

Users are responsible for supplying any legitimately obtained game data required by the client.

Availability of the Service is not guaranteed. Features, servers, accounts, characters, inventories, worlds, or other functionality may be changed, suspended, reset, or discontinued when reasonably necessary for operation of the project.

5. COMMUNITY CONTENT AND MODS

DFO Online may support community-created modifications, artwork, models, textures, scripts, sounds, and other content.

Contributors must only submit material that they created themselves or have sufficient permission or licensing rights to contribute.

Submitting content does not transfer ownership to DFO Online unless a separate written agreement expressly provides otherwise.

By intentionally submitting content for inclusion in DFO Online, the contributor represents that they have the rights necessary to permit the project's intended use of that content and grants DFO Online a non-exclusive license to host, reproduce, adapt, display, and use that contribution as reasonably necessary to operate and develop the project, subject to any separately agreed license terms.

Content known to violate another person's copyright or other intellectual-property rights may be removed.

6. THIRD-PARTY INTELLECTUAL PROPERTY

DFO Online respects third-party intellectual-property rights.

Third-party trademarks, copyrighted material, game data, community modifications, and other third-party material remain the property of their respective owners.

Nothing provided by DFO Online should be interpreted as granting a license to Bethesda, ZeniMax, Microsoft, or other third-party intellectual property beyond whatever rights the applicable rights holder has independently granted.

Rights holders or creators who believe their material is being used improperly may contact:

DFO Online will review legitimate intellectual-property complaints and take appropriate action when necessary.

7. DONATIONS AND COMMUNITY SUPPORT

The Service is free to access unless expressly stated otherwise.

DFO Online may accept voluntary financial support to assist with development, hosting, infrastructure, maintenance, and other project expenses.

A donation does not grant the donor ownership of DFO Online, Bethesda or ZeniMax intellectual property, community-created material, server infrastructure, or any other project asset unless a separate written investment or ownership agreement expressly provides otherwise.

Where permitted, supporters may receive community recognition, such as an original supporter designation or chat title.

Such recognition is intended as a community acknowledgment and does not grant ownership of or a license to Bethesda or ZeniMax intellectual property.

DFO Online does not sell ownership rights in Daggerfall, Morrowind, or other Bethesda/ZeniMax content.

Any supporter benefits are subject to modification or discontinuation if reasonably necessary for legal, licensing, operational, or technical reasons.

8. COSMETICS AND CUSTOM CONTENT

Any original cosmetic or custom content created specifically by DFO Online remains subject to the intellectual-property rights of its respective creator or applicable license.

DFO Online does not represent that modifications of third-party game assets become independently owned merely because they have been altered, converted, recolored, rendered, or otherwise modified.

Third-party intellectual property incorporated into custom content remains subject to the rights of its respective owner.

9. NO PAY-TO-WIN RIGHTS

Financial support does not create a contractual right to gameplay advantages, administrative authority, permanent server access, or preferential treatment.

Any recognition provided to supporters should not be interpreted as ownership of the project or any third-party game content.

10. USER CONDUCT

Users may not use DFO Online to:

Accounts may be suspended or terminated for violations of these Terms.

11. NO GUARANTEE OF CONTINUED SERVICE

DFO Online is an experimental community multiplayer project.

Servers, characters, accounts, items, titles, cosmetics, saves, progression, and other data may be modified, reset, suspended, or discontinued.

To the extent permitted by applicable law, the Service is provided without guarantees regarding uninterrupted availability or preservation of game/server data.

12. PROJECT CHANGES AND LEGAL COMPLIANCE

DFO Online may modify or remove features, assets, integrations, supporter benefits, or other content when reasonably necessary to address technical, licensing, intellectual-property, security, or legal concerns.

If a rights holder requests removal of material or functionality, the project may disable or remove that material while the matter is reviewed.

13. TRADEMARK NOTICE

The Elder Scrolls, The Elder Scrolls II: Daggerfall, The Elder Scrolls III: Morrowind, Bethesda, ZeniMax, and other associated names and marks belong to their respective owners.

Use of those names by DFO Online is intended to identify compatibility, required software, or the subject of this unofficial fan project and does not imply sponsorship, authorization, or endorsement.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, DFO Online and its contributors are not responsible for indirect, incidental, special, or consequential losses arising from use or inability to use the Service.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

15. CHANGES TO THESE TERMS

These Terms may be updated as the project, applicable licenses, legal requirements, or Service change.

Material revisions will be identified by updating the "Last Updated" date.

Continued use of the Service after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by applicable law.
